These General Terms and Conditions of Sale (GTC) apply automatically and without restriction to any purchase made from Hôtel-Dieu de Beaune, 2 rue de l’Hôtel-Dieu, 21200 BEAUNE, and the Hospices Civils de Beaune, Avenue Guigone de Salins, 21200 BEAUNE
GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – Acceptance of the Present General Terms and Conditions of Sale
1.1 The General Terms and Conditions of Sale apply without restriction or reservation to all sales operations offered by Hôtel-Dieu – Hospices Civils de Beaune and the Hospices Civils de Beaune, concluded with any individual of legal age or legal entity, whether acting as a consumer or professional (hereinafter the “Client”), as defined in the preliminary articles of the French Consumer Code. Depending on the nature of the sale, the General Terms and Conditions of Sale may be supplemented by a Quote / Purchase Order / Agreement or / Contract, which shall prevail over these General Terms and Conditions of Sale in the event of any contradiction. Specific conditions may apply depending on the service sold. These terms and conditions form an integral part of the sales contract.
1.2 The Client declares that they have the legal capacity to enter into this contract, meaning they are of legal age and not under guardianship.
1.3 Confirmation of the order results in the conclusion of the final contract. This implies that the Client acknowledges having read these General Terms and Conditions of Sale prior to confirming their purchase and accepts them in their entirety without reservation.
The purchase of any services provided by Hôtel-Dieu and the Hospices Civils de Beaune implies the Client’s full adherence to the present terms.
The Client also accepts the provisions concerning safety and any additional regulations relating to access to the Hôtel-Dieu and the Hospices Civils de Beaune sites.
The Client acknowledges that in the event of non-compliance with these regulations, access to the site may be refused without compensation, or their visit may be interrupted and they may be escorted off the premises of the Hôtel-Dieu and the Hospices Civils de Beaune sites.
The applicable General Terms and Conditions of Sale are those in force on the date the product is purchased. Hôtel-Dieu and the Hospices Civils de Beaune reserve the right to adapt or modify these General Terms and Conditions of Sale at any time and without prior notice, to the extent permitted by law or in the general interest.
The language of these General Terms and Conditions of Sale is French. In the event of a translation of all or part of these conditions, only the original French text shall be deemed authentic.
Article 2 - Orders
The Hôtel-Dieu and the Hospices Civils de Beaune have committed that, after confirmation of the availability of the service and/or product and of the Order to the Client, and payment by the Client of the amount stipulated in the Purchase / Online Purchase / Quote / Purchase Order / Agreement or / Contract, whether it be a deposit or the full price.
Article 3 - Price and payment
All prices are displayed in EURO. They must be verified by the Client at the time of validation of the Order. Except as otherwise provided in the Special Conditions, the Hôtel-Dieu and the Hospices Civils de Beaune accept payment by:
– Bank card (Carte Bleue, Visa, Eurocard / Mastercard),
– Bank checks drawn on a French institution,
– Bank transfers: bank transfer fees shall be borne by the Client,
– Cash, which is only accepted on the premises of the Hôtel-Dieu of the Hospices Civils de Beaune.
No discount is granted in case of full advance payment.
Article 4 - Liability
4.1 Hôtel-Dieu and the Hospices Civils de Beaune cannot be held liable if the non-performance or improper performance of their obligations under the general terms and conditions of sale is due to an unforeseeable and irresistible act of a third party or a force majeure event as recognized by the case law of French courts and tribunals.
This shall notably apply in cases of strikes affecting transportation or personnel, attacks, insurrection, riots, energy supply difficulties, pandemics or epidemics, and any prohibition imposed by governmental authorities.
Hôtel-Dieu and the Hospices Civils de Beaune shall also not be held liable in the event of the following occurrences:
– Theft, loss of money or valuables belonging to Clients or participants occurring during the service covered by the contract.
– Damage that the Client or participants may cause to themselves or others during fights or accidents resulting from, or unrelated to, alcohol intoxication or drug use.
– Direct or indirect damage of any kind to objects or equipment carried or deposited by the Client or participants during the service covered by the contract.
– Direct or indirect damage of any kind that the Client or participants may cause to one or more service providers or their staff involved under the contract.
– Damage caused by the Client or participants to the equipment, facilities, and/or premises of one or more service providers involved under the contract.
Any repairs or reimbursements deemed necessary due to the aforementioned damages shall be the sole responsibility of the Client, who agrees to bear the costs of restoration.
4.2 Each visitor must comply with the regulations of Hôtel-Dieu and the Hospices Civils de Beaune, some provisions of which are presented in the Frequently Asked Questions.
4.3 The websites of Hôtel-Dieu and the Hospices Civils de Beaune, as well as all their components such as logos, images, and content, are the property of Hôtel-Dieu and the Hospices Civils de Beaune. Any reproduction or use other than for personal and family purposes must be subject to prior request and authorization from Hôtel-Dieu and the Hospices Civils de Beaune.
Article 5 – Personal Data
In accordance with French Law No. 78-17 of January 6, 1978 as amended, relating to information technology, files, and civil liberties, and with European Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, Hôtel-Dieu – Hospices Civils de Beaune respects the confidentiality, integrity, and security of the data that the Client may provide in connection with placing or fulfilling an order.
The personal information and data transmitted to the Hospices Civils de Beaune by the Client are subject to computerized processing and may be used by the Hospices Civils de Beaune, its internal departments, its subcontractors, its partners, or its legal successors, according to the authorizations granted by the Client, for the following purposes:
The Hospices Civils de Beaune undertake not to disclose Client information to third parties other than their partners and subcontractors responsible for managing, executing, processing, payment, and/or monitoring services and purchases. The Hospices Civils de Beaune reserve the right, if necessary, to transmit the Client’s data to partner companies solely for the purposes of organizing the execution of the Order. The Hospices Civils de Beaune may also be required to disclose this data to comply with a legal order from the authorities.
If a Client Account is created on the reservation sites, this data is also stored there and accessible using the login and password provided during registration.
The Client has, at any time, the rights of access, inquiry, restriction, portability, erasure, modification, and rectification of their personal data under the conditions and within the limits set by the General Data Protection Regulation (GDPR) of April 27, 2016, and the amended French Data Protection Act of January 6, 1978.
The Client may unsubscribe from mailing lists at any time.

Article 6 – Termination
Without prejudice to any compensation that may be obtained or claimed, in the event of the Client’s failure to comply with any of their obligations, in particular, in the event of non-payment of the Order price, in whole or in part, as well as in the event of any action(s) by the Client likely to harm the reputation and/or image of the Hôtel-Dieu and the Hospices Civils de Beaune, the latter shall be entitled to terminate all or part of the order, without notice, after a formal notice sent by registered letter with acknowledgment of receipt has remained without effect for fifteen (15) days.
Article 7 – Entirety of the Terms and Conditions
Any change in legislation, regulation, or a court decision rendering one or more clauses of these General Terms and Conditions null and void shall not affect the validity of the other provisions of these General Terms and Conditions or of any special terms of sale.
Article 8 – Governing Law, Disputes, and Mediation
The Hôtel-Dieu and the Hospices Civils de Beaune disclaim all liability for any damage, regardless of its nature, that may affect the belongings, objects, or equipment brought by visitors. Sales covered by these General Terms and Conditions are subject to French law. The parties will endeavor, as far as possible, to settle their dispute amicably; failing that, the Administrative Court of Dijon shall have sole jurisdiction.
