PREAMBLE
These General Terms and Conditions of Sale (GTC) apply automatically and without restriction to any purchase made from Hôtel-Dieu de Beaune, 2 rue de l’Hôtel-Dieu, 21200 BEAUNE, and the Hospices Civils de Beaune, Avenue Guigone de Salins, 21200 BEAUNE

GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – Acceptance of the Present General Terms and Conditions of Sale
1.1 The General Terms and Conditions of Sale apply without restriction or reservation to all sales operations offered by Hôtel-Dieu – Hospices Civils de Beaune and the Hospices Civils de Beaune, concluded with any individual of legal age or legal entity, whether acting as a consumer or professional (hereinafter the “Client”), as defined in the preliminary articles of the French Consumer Code. Depending on the nature of the sale, the General Terms and Conditions of Sale may be supplemented by a Quote / Purchase Order / Agreement or / Contract, which shall prevail over these General Terms and Conditions of Sale in the event of any contradiction. Specific conditions may apply depending on the service sold. These terms and conditions form an integral part of the sales contract.
1.2 The Client declares that they have the legal capacity to enter into this contract, meaning they are of legal age and not under guardianship.
1.3 Confirmation of the order results in the conclusion of the final contract. This implies that the Client acknowledges having read these General Terms and Conditions of Sale prior to confirming their purchase and accepts them in their entirety without reservation.
The purchase of any services provided by Hôtel-Dieu and the Hospices Civils de Beaune implies the Client’s full adherence to the present terms.
The Client also accepts the provisions concerning safety and any additional regulations relating to access to the Hôtel-Dieu and the Hospices Civils de Beaune sites.
The Client acknowledges that in the event of non-compliance with these regulations, access to the site may be refused without compensation, or their visit may be interrupted and they may be escorted off the premises of the Hôtel-Dieu and the Hospices Civils de Beaune sites.
The applicable General Terms and Conditions of Sale are those in force on the date the product is purchased. Hôtel-Dieu and the Hospices Civils de Beaune reserve the right to adapt or modify these General Terms and Conditions of Sale at any time and without prior notice, to the extent permitted by law or in the general interest.
The language of these General Terms and Conditions of Sale is French. In the event of a translation of all or part of these conditions, only the original French text shall be deemed authentic.

Article 2 - Orders
The Hôtel-Dieu and the Hospices Civils de Beaune have committed that, after confirmation of the availability of the service and/or product and of the Order to the Client, and payment by the Client of the amount stipulated in the Purchase / Online Purchase / Quote / Purchase Order / Agreement or / Contract, whether it be a deposit or the full price.

Article 3 - Price and payment
All prices are displayed in EURO. They must be verified by the Client at the time of validation of the Order. Except as otherwise provided in the Special Conditions, the Hôtel-Dieu and the Hospices Civils de Beaune accept payment by:
– Bank card (Carte Bleue, Visa, Eurocard / Mastercard),
– Bank checks drawn on a French institution,
– Bank transfers: bank transfer fees shall be borne by the Client,
– Cash, which is only accepted on the premises of the Hôtel-Dieu of the Hospices Civils de Beaune.
No discount is granted in case of full advance payment.

Article 4 - Liability
4.1 Hôtel-Dieu and the Hospices Civils de Beaune cannot be held liable if the non-performance or improper performance of their obligations under the general terms and conditions of sale is due to an unforeseeable and irresistible act of a third party or a force majeure event as recognized by the case law of French courts and tribunals.
This shall notably apply in cases of strikes affecting transportation or personnel, attacks, insurrection, riots, energy supply difficulties, pandemics or epidemics, and any prohibition imposed by governmental authorities.
Hôtel-Dieu and the Hospices Civils de Beaune shall also not be held liable in the event of the following occurrences:
– Theft, loss of money or valuables belonging to Clients or participants occurring during the service covered by the contract.
– Damage that the Client or participants may cause to themselves or others during fights or accidents resulting from, or unrelated to, alcohol intoxication or drug use.
– Direct or indirect damage of any kind to objects or equipment carried or deposited by the Client or participants during the service covered by the contract.
– Direct or indirect damage of any kind that the Client or participants may cause to one or more service providers or their staff involved under the contract.
– Damage caused by the Client or participants to the equipment, facilities, and/or premises of one or more service providers involved under the contract.
Any repairs or reimbursements deemed necessary due to the aforementioned damages shall be the sole responsibility of the Client, who agrees to bear the costs of restoration.
4.2 Each visitor must comply with the regulations of Hôtel-Dieu and the Hospices Civils de Beaune, some provisions of which are presented in the Frequently Asked Questions.
4.3 The websites of Hôtel-Dieu and the Hospices Civils de Beaune, as well as all their components such as logos, images, and content, are the property of Hôtel-Dieu and the Hospices Civils de Beaune. Any reproduction or use other than for personal and family purposes must be subject to prior request and authorization from Hôtel-Dieu and the Hospices Civils de Beaune.

Article 5 – Personal Data
In accordance with French Law No. 78-17 of January 6, 1978 as amended, relating to information technology, files, and civil liberties, and with European Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, Hôtel-Dieu – Hospices Civils de Beaune respects the confidentiality, integrity, and security of the data that the Client may provide in connection with placing or fulfilling an order.
The personal information and data transmitted to the Hospices Civils de Beaune by the Client are subject to computerized processing and may be used by the Hospices Civils de Beaune, its internal departments, its subcontractors, its partners, or its legal successors, according to the authorizations granted by the Client, for the following purposes:
  • Processing, execution, and management of online product purchases;
  • Processing information requests and/or complaints;
  • Informing the Client about upcoming events, including by sending newsletters;
  • Informing the Client in the event of a possible postponement, cancellation, or closure;
  • Improving and personalizing the services offered by the Hospices Civils de Beaune to the Client.
Hôtel-Dieu and the Hospices Civils de Beaune collect and retain data exclusively and for the strictly necessary duration for the completion of the Order and in the event of the implementation of their contractual and/or tort liability.

The Hospices Civils de Beaune undertake not to disclose Client information to third parties other than their partners and subcontractors responsible for managing, executing, processing, payment, and/or monitoring services and purchases. The Hospices Civils de Beaune reserve the right, if necessary, to transmit the Client’s data to partner companies solely for the purposes of organizing the execution of the Order. The Hospices Civils de Beaune may also be required to disclose this data to comply with a legal order from the authorities.

If a Client Account is created on the reservation sites, this data is also stored there and accessible using the login and password provided during registration.

The Client has, at any time, the rights of access, inquiry, restriction, portability, erasure, modification, and rectification of their personal data under the conditions and within the limits set by the General Data Protection Regulation (GDPR) of April 27, 2016, and the amended French Data Protection Act of January 6, 1978.

The Client may unsubscribe from mailing lists at any time.

The Client may exercise these rights by providing proof of identity to our Data Protection Officer. By postal mail:

If, after contacting the Data Protection Officer of the Hospices Civils de Beaune, you believe that your rights are not being respected, you may file a complaint with the CNIL (https://www.cnil.fr/en/plaintes).

Article 6 – Termination
Without prejudice to any compensation that may be obtained or claimed, in the event of the Client’s failure to comply with any of their obligations, in particular, in the event of non-payment of the Order price, in whole or in part, as well as in the event of any action(s) by the Client likely to harm the reputation and/or image of the Hôtel-Dieu and the Hospices Civils de Beaune, the latter shall be entitled to terminate all or part of the order, without notice, after a formal notice sent by registered letter with acknowledgment of receipt has remained without effect for fifteen (15) days.

Article 7 – Entirety of the Terms and Conditions
Any change in legislation, regulation, or a court decision rendering one or more clauses of these General Terms and Conditions null and void shall not affect the validity of the other provisions of these General Terms and Conditions or of any special terms of sale.

Article 8 – Governing Law, Disputes, and Mediation
The Hôtel-Dieu and the Hospices Civils de Beaune disclaim all liability for any damage, regardless of its nature, that may affect the belongings, objects, or equipment brought by visitors. Sales covered by these General Terms and Conditions are subject to French law. The parties will endeavor, as far as possible, to settle their dispute amicably; failing that, the Administrative Court of Dijon shall have sole jurisdiction.
 
SPECIAL TERMS AND CONDITIONS OF SALE
Article 1 – Acceptance of the Special Terms and Conditions of Sale Relating to Online Booking Sites
Any person making a purchase on the online sites https://reservation-hoteldieu.hospices-de-beaune.com and https://booking-hoteldieu.hospices-de-beaune.com is invited to read all of the General Terms and Conditions of Sale (GTC) as well as these special terms and conditions.
These conditions define the contractual relationship between the person making the purchase, the Hôtel-Dieu, and the Hospices Civils de Beaune, as well as the conditions applicable to any online purchase made on the sites https://reservation-hoteldieu.hospices-de-beaune.com and https://booking-hoteldieu.hospices-de-beaune.com.
Confirmation of the order via these sites constitutes the conclusion of the final contract. This implies that the Client acknowledges having previously read and unreservedly accepted all of these conditions before validating their purchase.

The purchase of any services provided by the Hôtel-Dieu and the Hospices Civils de Beaune constitutes the Client’s full acceptance of these terms.
The Client also accepts the provisions regarding safety and any additional regulations relating to access to the Hôtel-Dieu and the Hospices Civils de Beaune sites.

The Client acknowledges that, should these regulations not be respected, access to the site will be refused without compensation, or their visit may be interrupted and they may be escorted out of the Hôtel-Dieu and the Hospices Civils de Beaune sites.

The applicable GTC are those in force on the date of the product purchase. The Hôtel-Dieu and the Hospices Civils de Beaune reserve the right to adapt or modify these GTC at any time and without prior notice, to the extent permitted by law or in the general interest.

Article 2 – Designation
These conditions apply fully and without restriction to any purchase made from the Hôtel-Dieu and the Hospices Civils de Beaune via the online sites https://reservation-hoteldieu.hospices-de-beaune.com and https://booking-hoteldieu.hospices-de-beaune.com.
https://reservation-hoteldieu.hospices-de-beaune.com and https://booking-hoteldieu.hospices-de-beaune.com are the online booking services of the Hôtel-Dieu and the Hospices Civils de Beaune. This service allows, among other things, the purchase of tickets to enjoy all the offerings included in the Hôtel-Dieu’s program and events.

Article 3 – Definitions
All the terms defined below, whether used in the singular or plural, are used with the following meanings:

“TICKET,” “CONFIRMATION,” “ORDER,” or “BOOKING”: refer to the means allowing access to the Hôtel-Dieu and the surrounding sites of the Hospices Civils de Beaune, regardless of the offering, according to the order placed by the Client on the website.

“Offering,” “Service,” “Activity,” “Tour”: refer to the program and offerings developed by the Hôtel-Dieu teams.

“Client”: refers to any person purchasing a TICKET, regardless of the offering, on the website and having accepted the terms of sale as provided in this document.

Article 4 – Prices and Scope of Application
4.1 The purchase of TICKETS is reserved for individual visitors.

4.2 Groups of 10 or more people may request a reservation by contacting the Visitor Reception & Relations Department using the form available online, by telephone, or by email.

4.3 The price of TICKETS is indicated in EUROS, all taxes included (VAT included), and includes processing fees.

4.4 The applicable prices are those in effect on the day of the order.

4.5 All prices are subject to change without prior notice. However, TICKETS will be invoiced based on the rates in effect at the time the order is confirmed by the Client.

4.6 The purchase is validated only after confirmation of the order and payment. The Client must verify this at the time of confirming the order.

4.7 Clients who have purchased TICKETS at a preferential or free rate must present valid proof on site on the day of the visit. If the proof cannot be presented, the Client will be required to pay at the ticket office an additional amount corresponding to the difference.

4.8 After the purchase has been validated, no discount or free entry can be applied, regardless of the reason. The Hôtel-Dieu and Hospices Civils de Beaune cannot retroactively apply discounts or free entry for the Client. Once the TICKET is purchased online, the Client waives the right to any discount or free entry to which they may have been entitled.

4.9 In the event of construction work, partial closure of the tour route, or reduced opening hours, the prices will, except in special cases, remain unchanged. TICKETS purchased online will not be subject to any discount or refund. Whenever possible, such exceptional cases will be communicated in advance.

4.10 TICKETS may not be resold at a higher price (law of June 27, 1919).

Article 5 – Availability of TICKETS for Sale
5.1 The Hôtel-Dieu and Hospices Civils de Beaune offer a predefined quantity of time-stamped TICKETS for sale and reserve the right to increase or decrease the number of TICKETS available.

5.2 The TICKET is sold for a specific day and time of visit chosen by the Client. The purchase of TICKETS is done in real time. The Client is informed of TICKET availability at the time of placing the order.

Article 6 – Access Conditions
6.1 Access Times – Self-Guided Tour Service
The time is confirmed at the time of order. It must be respected. Otherwise, access to the site cannot be guaranteed. No subsequent claims will be considered.

6.2 Access Times – Time-Stamped Service
The purchase of a TICKET for a time-stamped service is valid for a specific date and time. The date, time, and access location are indicated on the TICKET. The time is confirmed at the time of order. It must be respected. Otherwise, access to the site cannot be guaranteed. No subsequent claims will be considered.

Article 7 – Order
All orders must be paid in EURO.
The Client must purchase TICKETS on the online sites https://reservation-hoteldieu.hospices-de-beaune.com or https://booking-hoteldieu.hospices-de-beaune.com.

Order steps :
7.1 Select the desired service.

7.2 Select the desired date using the calendar, then choose the time slot from those available.

7.3 Select the applicable rates and the desired quantity of TICKETS, then add them to the cart.

7.4 Check the order summary displayed. The Client can still modify the selection as desired or continue shopping.

7.5 To finalize the order and receive the TICKETS, the Client may, at their choice:
  • Enter the necessary information for sending and verifying the TICKET: email address, last name and first name, postal code, postal address (optional), telephone number (optional);
  • Log in to their Client account secured by entering a username and password.
Creating an account with a password can also be done before confirming the order.

7.6 Read and accept the general terms and conditions of sale by ticking the box “I accept the general and special terms and conditions of sale.”

Article 8 – Order Validation
8.1 Order Validation. By validating the order, the Client accepts the general and specific terms and conditions of sale.

8.2 Payment by entering bank details and final confirmation. The order for TICKETS will be considered final after payment has been accepted by the merchant processing center. In the event of a refusal by the payment center, the order is automatically cancelled.

8.3 Receipt of order confirmation email. The Client is invited to check their email inbox (including the main inbox and possibly the spam folder).

8.4 For any cancellation request after validation of the transaction, please refer to Article 14 below.

Article 9 – Payment Terms
9.1 Payment for TICKETS by the Client is made exclusively online and in EURO. Tickets purchased on the website can only be paid for by credit card (Carte Bleue / Visa / Mastercard) and cards compatible with the secure Payzen payment site.

9.2 After payment has been accepted by the processing center, the Client is redirected to a page indicating that the payment has been successfully completed. The order is then sent to the email address provided during the order process. This order includes, among other things, the TICKETS.

9.3 In the event of payment refusal by the banking institution, the Client is redirected to a page indicating that the payment has been refused. The order is then automatically cancelled.

Article 10 – Obtaining the TICKETS
10.1 After payment for the order has been accepted, the Client will receive an email with the TICKETS attached in PDF format.

The issued TICKETS are unique. No duplicates will be provided.

10.2 The Client has the option to either:
  • Print their TICKET on white A4 paper, without modifying the print size. Partially or poorly printed, damaged, or illegible TICKETS will not be accepted and may be considered invalid. Each print-at-home TICKET contains a unique barcode or QR code. The validity of the TICKET is checked and recorded at the entrance of the Hôtel-Dieu and the Hospices Civils de Beaune sites using barcode and QR code readers. It is not possible to be admitted more than once with the same TICKET. The reproduction of TICKETS is prohibited. The first person presenting the TICKET is presumed to be the legitimate holder. Therefore, it is forbidden to reproduce, duplicate, or counterfeit the TICKET.
  • Download their TICKET onto a smartphone or tablet. Partially downloaded, damaged, or illegible documents will not be accepted and may be considered invalid.
To be read, digital TICKETS must be presented at the access control under the following conditions:
- on a smartphone
- with a charged battery
- at maximum brightness
- with a screen in perfect condition

Without these conditions, the Client risks the TICKET not being readable and may be denied entry.

The Client must print or download all TICKETS received by email.

The TICKET cannot be issued, printed, or downloaded by the Hôtel-Dieu or the Hospices Civils de Beaune on the day of the Client’s visit.

The payment or order confirmation does not constitute a TICKET. These documents cannot be used as a TICKET and do not grant access to the Hôtel-Dieu or the Hospices Civils de Beaune sites.

Article 11 – Information on the TICKET
The issued TICKET contains the following information:
- the mention “Hôtel-Dieu” or “Hospices Civils de Beaune”
- the type of service
- the type of rate applied
- the sale price in EURO
- the date and time of validity
- the QR code
- the booking reference number and the date it was created

Article 12 – Conditions of Use of TICKETS
12.1 Partially or poorly printed, damaged, or illegible TICKETS are not accepted and may be considered invalid.

12.2 The Client must present themselves to the control staff at the entrance of the designated site with a TICKET that has been printed in advance or displayed on a digital device. Every TICKET is systematically checked by scanning the barcode or QR code.

12.3 Each TICKET is time-stamped and valid only for the date and time indicated on it. The time is confirmed at the time of ordering and must be respected. Otherwise, access to the site cannot be guaranteed. No subsequent claims will be considered.

12.4 Clients who have purchased TICKETS at a reduced or free rate must present valid supporting documentation on site on the day of the visit. If the supporting document cannot be presented, the Client will be required to pay at the ticket office the difference corresponding to the full price

12.5 Each TICKET is valid for a single entry.
 
12.6 The first person to present the TICKET is presumed to be the legitimate holder. The TICKET must be kept until the end of the visit. Any other person presenting the same TICKET for a second time will be denied access.

Article 13 – Liability
13.1 The Client undertakes to check the TICKET(s) at the time of online purchase confirmation and when they are issued and received in their email inbox. The Client remains solely responsible for the use of the TICKETS.

13.2 As specified in the General Terms and Conditions of Sale, Hôtel-Dieu and the Hospices Civils de Beaune cannot be held liable if the non-performance or improper performance of their obligations under the general terms and conditions is attributable to an unforeseeable and irresistible act of a third party.

13.3 Each visitor must comply with the rules and regulations of the Hôtel-Dieu and the Hospices Civils de Beaune, some of which are presented in the Frequently Asked Questions.

13.4 In the event of loss, theft, or duplication of a TICKET, Hôtel-Dieu and the Hospices Civils de Beaune cannot be held liable under any circumstances. Only the first person presenting the said TICKET is considered to be the legitimate holder. Under no circumstances can a duplicate TICKET be issued on site.

13.5 Hôtel-Dieu and the Hospices Civils de Beaune cannot guarantee that no errors may occur during the Client’s use of the booking sites. These sites are accessible 7 days a week and 24 hours a day, except in cases of closure for maintenance, repair, or force majeure.
Hôtel-Dieu and the Hospices Civils de Beaune cannot be held liable for any loss of data or damage (intrusion, virus, service interruption) suffered by the Client as a result of a failure to access the site or the internet network when placing an order.
Furthermore, Hôtel-Dieu and the Hospices Civils de Beaune cannot be held responsible for any malfunction related to compatibility issues between the TICKET delivery methods and the Client’s IT environment.

13.6 The booking sites and all their components, such as logos, images, and content, are the property of Hôtel-Dieu and the Hospices Civils de Beaune. Any reproduction or use other than for personal and family use must be subject to a prior request and will require authorization from Hôtel-Dieu and the Hospices Civils of Beaune.

Article 14 – Cancellation and Refund
14.1 A TICKET or equivalent cannot be returned, exchanged, or refunded, except for TICKETS sold for the Hôtel-Dieu in cases of force majeure, upon presentation of supporting documentation.

14.2 Changing the date or time is not possible once payment has been confirmed.

14.3 A TICKET may not be resold at a price higher than its face value.

14.4 In the event of cancellation or closure of the sites by the Hospices Civils de Beaune, the TICKET paid for by the Client may be:
  • Either postponed to a later date, subject to availability;
  • Or refunded, to the exclusion of any other compensation or indemnity.
No refunds will be made on site.

Any request for refund or justified claim must be sent by email to hospices.hoteldieu@ch-beaune.fr.

14.5 Where possible, the Hôtel-Dieu and the Hospices Civils de Beaune undertake to communicate exceptional closures via their various communication channels, as well as to buyers by sending an email to the address provided at the time of purchase.

14.6 In accordance with Article L 221-28-12 of the French Consumer Code, the right of withdrawal does not apply to the sale of TICKETS considered as leisure activity services.

Article 15 – Payment Security
TICKETS purchased are payable only by bank card (Carte Bleue, Visa, Mastercard) and cards compatible with the secure Payzen payment site.
The Client’s information entered when providing bank details is encrypted to protect all sensitive data as effectively as possible during payment. The online payment transaction is managed by the Payzen system. This data transaction is secured by SSL (Secure Socket Layer) and 3D Secure encryption.
At no time do bank card details transit through the servers of the Hôtel-Dieu and Hospices Civils de Beaune.
